DISTANCE SALES AGREEMENT (Türkbükü Çiçek – Craftsman ® Bülent Mumcu A.Ş.) The BUYER is responsible for ensuring that the delivery address is accurate and complete. 3.3 Delivery to Third Parties If the product is to be delivered to a third party or another institution at the BUYER’s request, the SELLER is not responsible if the recipient refuses the delivery. 3.4 Payment Requirement for Delivery The product(s) will be delivered only after full payment is received. If the BUYER fails to complete the payment, or if the bank cancels the transaction, the SELLER is not obliged to proceed with the delivery. 3.5 Force Majeure and Delivery Delays If unexpected situations such as natural disasters, transportation disruptions, or extreme weather conditions prevent timely delivery, the SELLER must notify the BUYER. The BUYER may choose to: Cancel the order and request a full refund. Request a replacement product if available. Postpone delivery until the issue is resolved. If the BUYER cancels the order, the full amount will be refunded in cash. --- ARTICLE 4 – RIGHT OF WITHDRAWAL & ORDER CANCELLATION 4.1 Consumer’s Right of Withdrawal Under the Regulation on Distance Contracts, the right of withdrawal does not apply to perishable goods such as fresh flowers, as they are custom-made and are immediately consumed upon delivery. 4.2 Order Cancellation The BUYER can request an address or delivery date change at least 6 hours before the scheduled delivery time. Orders can be canceled only before preparation and dispatch. The status of the order can be tracked via the email activation code sent at the time of purchase or by contacting +90 532 213 95 34. 4.3 Refund Process Refunds for payments made via bank transfer (Havale/EFT) will be processed to the BUYER’s account (must match the invoice name). If the payment was made via credit card, the refund will be processed according to the BUYER’s bank’s policy. The SELLER is not responsible for any delays caused by the bank. If the product was custom-designed, expenses incurred during the preparation process will be deducted before issuing a refund. --- ARTICLE 5 – PAYMENT TERMS & LATE PAYMENT 5.1 Credit Card Payments & Installments If the BUYER used an installment plan, the bank may refund the amount in the same number of installments as the original purchase. If the card statement date conflicts with the refund period, the BUYER may still need to complete pending installment payments before receiving the full refund. 5.2 Late Payment & Legal Consequences If the BUYER fails to make a payment using a credit card, they are subject to late fees and penalties as per their bank’s credit card agreement. The SELLER reserves the right to initiate legal action, file a debt collection claim, and pursue any other necessary legal remedies to recover the outstanding amount. --- ARTICLE 6 – PERSONAL DATA COLLECTION & PRIVACY 6.1 Consent to Data Collection By using the www.turkbukucicek.com website, the BUYER consents to the collection and use of their personal information for transaction security and verification purposes. 6.2 Required Information The BUYER must provide the following details: Full name Contact number Email address Delivery address Payment details (credit/debit card number, expiration date, security code) Recipient information All collected data is securely stored and protected. Failure to provide required information may result in order cancellation or service disruption. 6.3 Purpose of Data Collection The SELLER may use BUYER data for the following purposes: Processing and managing orders Marketing services & promotional campaigns Conducting customer satisfaction surveys Analyzing website performance & user preferences Personalized recommendations & advertisements Identity verification & fraud prevention Collected data will be stored only for the legally required duration and will not be shared with third parties without explicit consent. --- ARTICLE 7 – OTHER TERMS & CONDITIONS 7.1 Delivery Fees In some regions, an extra transportation fee may apply.
